What are the rules pertaining to Salah for a Ma’zoor?

Assalamualikum,i have gas problem and pass wind most of the time and i  cant’t perform salah without passing wind.so i have read in your fatwas that iam mazoor,that one wudhu i can perform salah of that time.but my question is if i make wudhu before fajar is it valid to read ishraq salah with that wazu as the time of fajar ends. And in maghrib,do i have to make wuzu only after maghrib prayer time has started,at azaan time or i can make it ahead of maghrib time 10mins before and come to masjid for dua.then perform salah with that wudu.please clarify and give a clear answer.jazakallah

When does one become a Ma’zoor (excused person)?

If a person is unable to maintain his wudhu for an entire Salah time, to the extent that he can’t perform wudhu and pray Salah, then such a person is classified as a Ma’zoor.

For example: Zaid is constantly passing wind. The duration of Maghrib Salah is 1 hour 30 minutes. Zaid requires 10 minutes to be able to perform wudhu and pray Maghrib Salah. During this entire 1 hour 30-minute period, Zaid is unable to keep his wudhu for even 10 minutes. In this case, Zaid is Ma’zoor.

How long will a person remain Ma’zoor?

Once a person is classified as Ma’zoor, he will remain Ma’zoor for as long as the cause (in this case, the passing of wind), is found even once during each Salah time. If one entire Salah time passes and the cause of becoming Ma’zoor does not take place even once, then this person will no longer remain Ma’zoor.

For example: Zaid has been classed as Ma’zoor. It is now time for Maghrib Salah. Maghrib Salah time will be 1 hour and 30 minutes. After already being classified as Ma’zoor, if in this entire 1 hour 30-minute period, Zaid passes wind only once, he will remain a Ma’zoor. However, if the full Salah time passes and Zaid does not even pass wind once, he will no longer remain Ma’zoor.

Rulings of Wudhu for a Ma’zoor:

1)    A Ma’zoor must make a fresh wudhu for every Fardh Salah time.

2)    The wudhu performed will be sufficient for all other Nafl prayers and teaching Quran etc. during that Salah time.

3)    The wudhu will expire with the expiry of each Salah time and a fresh wudhu will need to be performed for the next Salah time.

4)    Any reason which normally breaks wudhu will still break the wudhu (only the cause of becoming Ma’zoor will be excused, in this case the passing of wind.)

It will not be valid for a Ma’zoor, to perform Ishraaq Salah with the wudhu of Fajr as the expiry of a Salah time terminates the wudhu of a Ma’zoor person. Accordingly, wudhu performed for the Fajr Salah will expire upon the expiry of the Fajr Salah. A fresh wudhu must be performed for Ishraaq Salah.

A Ma’zoor can perform wudhu for Maghrib Salah only when the Maghrib time sets in, i.e. upon sunset. A Ma’zoor cannot make wudhu for Maghrib Salah before sunset.[1]

اگر ایک مرتبہ کسی نماز کا کامل وقت اس حالت میں گزر جائے کہ اخراج ریح مسلسل رہے یعنی اتنی دیر کے لئے بند نہ ہو کہ وہ وضو کرکے وقتیہ نماز پوری کر سکے تو یہ شخص معذور ہے، اس کا حکم یہ ہے کہ ہر وقت کے لئے اس کے ذمہ وضو ضروری ہے اور اس وضو سے فرض،نفل،ادا،قضا جو دل چاہے پڑھتا رہے، خروج ریاح ناقض نہیں ہو گا، وقت جارج ہونا اس کے حق میں ناقض ہے ۔ ہر وقت کے لیے علیحدہ وضو ضروری ہے۔ اور یہ شخص معذور رہے گا جب تک کہ کسی ایک نماز کے کامل وقت عذر سے خالی نہ گزر جاۓ، یعنی معذور رہنے کے لیۓ یہ ضروری نہیں ہے کہ عذر مسلسل رہے البتہ یہ ضروری ہے کہ ہر نماز کے کامل وقت میں ایک دو مرتبہ عذر کا تحقق ہو جائے ۔ اور جب ایسی حالت آجائے گی کہ کامل وقت ایک مرتبہ بھی عذر سے جالی عذر جائےگا تو یہ شخص معذور نہ رہے گا، اور اگر کسی کامل وقت ایسا نہیں گزرا کہ اس کو عذر سے خالی رہ کر نماز ادا کرنا ممکن ہو بلکہ اتنی گنجائش مل جاتی ہیں کہ ہر وقت میں بلا عذر ادا کر سکتے ہے تو یہ معذور نہیں ہے خروج ریاح اس کے حق میں ناقض وضو ہے۔

 

فتاوی رحیمیۃ (67/4)

نکسیر کا جاری رہنا، قطرہ کا آنا، خروج ریح وغیرہ کے مریض نماز کے پورے وقت میں وضو کر کے نماز نہ پڑھ سکے تو عذر کے ختم ہونے تک معذور شمار ہوگا، اس کا حکم یہ ہے کہ ہر وقت نماز کے لئے وضو کر لیا کرے جب تک وہ نماز کا وقت رہے گا اس وضو سے جتنی نمازیں چاہے پڑھ سکتا ہے، البتہ جس بیماری میں مبتلا ہے اس کے سوا اگر کوئی بات ایسی پانی جائے جس وضو ٹوٹ جاتا ہے تو وضو جاتا رہے گا۔

اس صورت میں آپ اس وقت معذور مانے جائے گے جب کہ آپ کو قطرہ پیشاب نکلنے اور خروج ریاح سے اتنے وقت نہ ملے کہ اس میں صحیح سے نماز پڑھ سکے اور یہ عذر پورا وقت رہے، تو آپ معذور ہے، عذر کی یہ شرط ابتداء ہے پہر بعد میں دیگر نماز میں ایک آدھ مرتبہ ع زر کا پایا جانا کافی ہو گا لہذا ہر نماز کے وقت میں وضو کرے۔

 

احسن الفتاوی (74/2)

صاحب عذر بننے کے لئے یہ ضروری ہے کہ نماز کے پورے وقت میں سے اتنا وقت نہ ملے جس میں وضو کرکے طہارت کے ساتھ نماز ادا کر سکے۔ شرعا معذور بن جانے کے بعد آئندہ پورے وقت میں ایک دفعہ عذر پایا جانا کافی ہے، زوال عذر کے لئے ضروری ہے کہ پورا وقت عذر سے کلیۃ خالی نکل جائے، صاحب عذر کے لئے ہر وقت فرض کے لئے وضو کرنا ضروری ہے اور اسی وضو سے فرض واجب نفل جو چاہے وقت کے اندر پڑھ سکتا ہے۔
