Mustahada’s ruling regarding wudhu

Salaams. I am currently experiencing istehaza and know that wudhu last from one salaah time until the next. I am keeping qaza fast and Sheri ends 10 mins before fajr salaah. I therefor made wudhu at this time (which was 10 mins early) so would my wudhu be valid and the salaah I prayed? Jzk

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

 

You state that you are experiencing istihaada and you know that wudu lasts from  one salah time until the next. Sister, this is not a general ruling for istihaada. There are 2 types of istihaadah. The first is a woman who experiences istihaadah but does not have a continuous flow of blood for an entire salah time. Such a woman is not in the category of a ma’zoor (excused person) person. Her wudu will break immediately when she has a discharge. Her wudu will not last for an entire salah time. The second category is a ma’zoor woman who experiences continuous blood flow for the entire salat to  an extent that she  can not perform wudu and two rakaat salat without having a discharge. In this instance, her discharge will not invalidate her wudu. Her wudu will remain intact for an entire salah time.

In principle, sehri times ends at subah saadiq, the time when Fajr Salah sets in. The 10 minutes mentioned between sehri and fajr salah has been given as a matter of precaution to ensure that people do not eat till the very last moment, thus risking their fasts.  Accordingly, If you made wudu ten minutes before the Fajr time set in, then your wudu will be invalidated. If you made wudu after Fajr time set in, then your wudu will be valid.

وتتوضّأ المستحاضة ومن به سلس البول أو استطلاق بطنٍ أو انفلات ريحٍ أو رعافٌ دائمٍ أو جرحٌ لا يرقأ لوقت كلّ فرضٍ

ويصلّون به فرضًا ونفلًا

ويبطل بخروجه فقط

والمستحاضة ومن به سلس البول والرعاف الدائم والجرح الذي لا يزقلأ يتوضئون لوقت كل صلاة فيصلون بذلك الوضوء في الوقت ما شاءوا من الفرائض والنوافل فإذا خرج الوقت بطل وضوءهم وكان عليهم استئناف الوضوء لصلاة أخرى

والمستحاضة وَمن بِهِ سَلس الْبَوْل والرعاف الدَّائِم وَالْجرْح الَّذِي لَا يرقأ يتوضؤن لوقت كل صَلَاة فيصلون بذلك الْوضُوء فِي الْوَقْت مَا شَاءُوا من الْفَرَائِض والنوافل وَإِذا خرج الْوَقْت بَطل وضوءهم واستأنفوا الْوضُوء لصَلَاة أُخْرَى

وصاحب عذر من به سلس ) بول لا يمكنه إمساكه ( أو استطلاق بطن أو انفلات ريح أو استحاضة ) أو بعينه رمد أو عمش أو غرب ، وكذا كل ما يخرج بوجع ولو من أذن وثدي وسرة ( إن استوعب عذره تمام وقت صلاة مفروضة ) بأن لا يجد في جميع وقتها زمنا يتوضأ ويصلي فيه خاليا عن الحدث ( ولو حكما ) لأن الانقطاع اليسير ملحق بالعدم ( وهذا شرط ) العذر ( في حق الابتداء ، وفي ) حق ( البقاء كفى وجوده في جزء من الوقت ) ولو مرة ( وفي ) حق الزوال يشترط ( استيعاب الانقطاع ) تمام الوقت ( حقيقة ) لأنه الانقطاع الكامل .

المحيط البرهاني في الفقه النعماني (1/ 51)

وإنما شرطنا استيعاب السيلان وقت صلاة كامل اعتباراً لظرف الثبوت بظرف السقوط، فإن المستحاضة إذا انقطع دمها وقت صلاة كامل خرجت من أن تكون مستحاضة، وإن كان أقل من ذلك لا تخرج من أن تكون مستحاضة،
