Thought of divorce and oath

Dear Askimam,

I have been married for quite some time now and I am content. Since the start of my marriage I have always been afraid of losing my wife due to my own stupidity or anger. Before we were married, I was a horrible person and that person honestly scares me. My question has a few parts and I will apologise in advance. 

These thoughts have been plaguing my mind for some time. It has plagued my mind so much that my wife does not want to talk to me anymore if she knows I will ask her about these thoughts. I feel like my day is constantly affected by these thoughts and whispers. I have also spent a lot of time on Askimam and Islamqa looking at the topic of D…… I have looked at the topic so much that It has affected both my life and marriage. So I shall begin.

A few weeks ago, I was on the toilet and I was thinking about all the fitnah and bad images on a social media app called Instagram. These images include girls who are immodestly dressed. The main reason I use the social media app is to keep in touch with friends and family. From a few weeks before this incident, I had already started to block out any one of the opposite gender on Instagram.

Whilst on the toilet a thought came to my head, but I can not remember the exact thought. This thought was one of the following

  • By Allah, if I ever unblock someone on Instagram I will D….. my wife
  • By Allah, if I ever unblock someone on Instagram, my wife is D……
  • By Allah, Whenever I unblock someone on Instagram, I will D…. my wife
  • By Allah, Whenever I unblock someone on Instagram, my wife is D….

my questions are as followed

  1. I did not say this oath verbally. I am also 99.99% sure I did not move my lips or tongue. No noise was made except for me breathing in and out. Can I ask if this oath is valid? 
  2. If I unblock someone on Instagram, does that count as a D….?
  3. If I delete my Instagram account and all the people I have blocked are immediately unblocked, does that count as a D……?
  4. If I make a new username on Instagram, will that count as a D….

I am sorry about the long question, but please try and understand that this thought has been plaguing my mind for quite some time. I would appreciate a prompt response.

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

Brother in Islaam,

The mere thought of divorce does not constitute divorce[1]. Moreover, an oath only contextualizes once it is verbalized[2].

In the enquired situation, your nikaah with your wife is intact and the oaths you refer to are invalid.

Do not entertain any thoughts of divorce. When the thought of divorce crosses your mind, consider them to be from Shaitaan and recite the following:

أعوذُ باِللهِ مِنَ الشَّيطَانِ الرَّجِيم[3]

Translation: I seek refuge in Allaah from the rejected devil.

لاحول ولا قوة إلا بالله

Translation: There is no power and no might except with Allaah.

If you are suffering paranoia of divorce and whispers from Shaitaan, and that is creating an instability in your marriage, you should inform two adult males of your condition and make them your witness that you have no intention of divorcing your wife when you experience such thoughts. Thereafter, be rest assured of your marriage being intact. There is no need to refer to your wife on the issue.

 الواو وفي المغرب رجل موسوس بالكسر ولا يقال بالفتح ولكن موسوس له أو إليه أي ملقى إليه الوسوسة وقال الليث: حديث النفس وإنما قيل موسوس؛ لأنه يحدث بما في ضميره وعن أبي الليث لا يجوز طلاق الموسوس يعني المغلوب في عقله عن الحاكم هو المصاب في عقله إذا تكلم تكلم بغير نظام.

(قوله وركنه لفظ مخصوص) هو ما جعل دلالة على معنى الطلاق من صريح أو كناية فخرج الفسوخ على ما مر، وأراد اللفظ ولو حكما ليدخل  الكتابة المستبينة وإشارة الأخرس والإشارة إلى العدد بالأصابع في قوله أنت طالق هكذا كما سيأتي. وبه ظهر أن من تشاجر مع زوجته فأعطاها ثلاثة أحجار ينوي الطلاق ولم يذكر لفظا لا صريحا ولا كناية لا يقع عليه كما أفتى به الخير الرملي وغيره، وكذا ما يفعله بعض سكان البوادي

قالوا : إن الطلاق يقع بالألفاظ المصحفة قضاء ولكن لا بد أن يقصدها باللفظ.
