Does a husband’s becoming an apostate affect the spouses marital status?

Answered as per Hanafi Fiqh by Askimam.org

Salaam,

Husband is from a Muslim family and was a muslim when he got married. But later got to know that his views are different and he is a atheist and does not believe in God. Does this make the husband/wife relationship haram and marriage void since he’s a non-muslim now?

Regards,

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If any one of the spouse leaves the fold of Islam, then the marriage terminates with immediate effect.[1]

Your marriage terminated the moment your husband turned atheist (May Allah guide him).

And Allah Ta’āla Knows Best
