Uttering words of divorce

Answered as per Hanafi Fiqh by DarulUloomTT.net

Q. If a husband uses the words to his wife, “you are nothing to me” or “you are not my wife” or “get out of my life” or “I don’t want you anymore” will that be a divorce and what type of divorce will it be and what is her status after that? Can she remarry him or does she have to marry someone else? It was sent to her in a text message.

A. If the husband used these statements with the intention that he did not want to live with the wife anymore and he wanted to divorce her (at the time of using these statements), then one irrevocable divorce has occurred. At this time, both will not be considered as husband and wife. The wife will be required to check her iddah (waiting period of three menses) upon this (the utterance of these statements by the husband). If both parties wish to remarry, they can do so without the wife/woman having to marry someone else.

And Allah knows best.
