If husband says to his wife ” the TALAQ UPTO YOU , WHENEVER YOU WANT. i want to give talak , but you start it and you wish ” now it is whose hand.
Answer:

By the abovementioned sentence, the right was transferred to the wife i.e. now she will have the right of divorce and she can use it anytime she likes:
قال لھا أنت طالق متی شئت و لایتقید بالمجلس ولا تطلق نفسھا الا واحدۃ لأنھا تعم الزمان لا الأفعال فتملک التطلیق فی کل زمان لا تطلیق بعد تطلیق و لھا تفریق الثلاث فی کلما شئت و لاتجمع (شامی: 2/531)
