Explanation of the Hadith Lying Is Not Permitted Except in Three Cases

Question:

As Salaamu Alaykum, with regards to the Hadith about who is not considered a liar (the 3 situations), if a person misunderstood and applied the one that mentioned the husband and wife to other family members I.e. if an elder asked you was the food nice and you may not have liked it a lot but you replied yes, what would be the result of believing that one can do this due their misunderstanding?

Answer:

The hadith in question is narrated in the Sunan of Imam Tirmidhi with the following wording: “Lying is not permitted except in three cases: a man who mentions something to his wife to please her, lying in war, and lying to rectify amongst people.”

Some scholars have interpreted lying here in its literal sense to be permissible in these scenarios. Other scholars like Imam Tabari [rahimahullah] have stated that lying is unlawful by default in all cases; what is meant in these scenarios is not literal lying but rather expressions of love and non-binding promises between spouses, and using implicit expressions like saying words with potential different meanings in a way that the listener thinks you mean one over the other. For example, in order to demoralise the enemy at war, you tell them their leader has been killed but you meant a past leader of theirs, not the current one.

Therefore, a person must always strive to be upright and truthful but in certain situations, for the goodness of relations, they may use expressions that the listener may interpret in a way that pleases them.

1939 حدثنا محمد بن بشار حدثنا أبو أحمد الزبيري حدثنا سفيان قال ح وحدثنا محمود بن غيلان حدثنا بشر بن السري وأبو أحمد قالا حدثنا سفيان عن عبد الله بن عثمان بن خثيم عن شهر بن حوشب عن أسماء بنت يزيد قالت قال رسول الله صلى الله عليه وسلم لا يحل الكذب إلا في ثلاث يحدث الرجل امرأته ليرضيها والكذب في الحرب والكذب ليصلح بين الناس وقال محمود في حديثه لا يصلح الكذب إلا في ثلاث هذا حديث حسن لا نعرفه من حديث أسماء إلا من حديث ابن خثيم وروى داود بن أبي هند هذا الحديث عن شهر بن حوشب عن النبي صلى الله عليه وسلم ولم يذكر فيه عن أسماء حدثنا بذلك محمد بن العلاء حدثنا ابن أبي زائدة عن داود وفي الباب عن أبي بكر

قال القاضي : لا خلاف في جواز الكذب في هذه الصور ، واختلفوا في المراد بالكذب المباح فيها ما هو ؟ فقالت طائفة : هو على إطلاقه وأجازوا قول ما لم يكن في هذه المواضع للمصلحة ، وقالوا : الكذب المذموم ما فيه مضرة ، واحتجوا بقول إبراهيم صلى الله عليه وسلم : بل فعله كبيرهم ، و إني سقيم ، وقوله : إنها أختي ، وقول منادي يوسف صلى الله عليه وسلم : أيتها العير إنكم لسارقون قالوا : ولا خلاف أنه لو قصد ظالم قتل رجل هو عنده مختف وجب عليه الكذب في أنه لا يعلم أين [ ص: 59 ] هو ، وقال آخرون منهم الطبري : لا يجوز الكذب في شيء أصلا ، قالوا : وما جاء من الإباحة في هذا المراد به التورية واستعمال المعاريض لا صريح الكذب ، مثل أن يعد زوجته أن يحسن إليها أو يكسوها كذا ، وينوي إن قدر الله ذلك (تحفة الأحوذي, كتاب البر والصلة عن رسول الله صلى الله عليه وسلم, باب ما جاء في إصلاح ذات البين, جزء ٦, صفحة ٦٠, المكتبة الإسلامية)
