Can one Consume Undelivered Uber Eats Food?

Question

السلام علیکم ورحمة اللّٰه و بركاته

Whilst delivering for Uber, if you can’t find the customer or access the building, you can contact them via phone or text. If they do not respond, then you inform Uber and they try to contact them. After seven minutes required waiting by Uber, you are paid for the delivery and they say, ”You can throw away the food.” Is it jaiz to consume?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Wa Alaykum Assalam,

If you have followed all the steps needed with due process and the food is halal or permissible, then it is jaiz for you to consume it as you are still “disposing” of the food. It should be noted that if you did not give a reasonable amount of time or due process, then this would not be permissible.[1] This is due to the fact that it is known that a person can take in his/her ownership something that is disposed of or thrown out.
