Question:

Zaid and Ismail are partners. Ismail is silent partner who helps when need me

Zaid runs business, by himself Ismail has no idea on day to day running.

Can Zaid take a salary?

Answer:

According to some Ulema it is permissible for Zaid to take a salary as it has now become a norm (Urf) in partnership, for an active partner to draw a salary.  However, according to these Ulema, this must be done with mutual agreement, whereby (after the establishment of the partnership), the employment contract should be regarded as an independent contract from the partnership agreement without one contract being conditional to the other. Thus, it will not be counted as two transactions in one, because our beloved Nabi ﷺ forbade combining two transactions in one. 

However, according to the majority of Ulema, it will not be permissible for the working partner to take a salary. This is the view that our Darul-Ifta also adheres to, which is why we would advise that Zaid should not be given a salary. To compensate Zaid for the work-input (as he is the active partner), the alternative would be to increase his profit margin. So for example, even though the capital investment of both partners is equal (50/50), the profit ratio  allocated for Zaid could be 70% as opposed to Ismail’s profit ratio being kept at 30%. This would then make it permissible and would also compensate Zaid for the effort that he is putting in.  If Zaid needs to take a monthly-drawing for his expenses, this should be recorded and at the end of the financial year when profits are worked out, this amount (that he drew during the year) will be deducted from his total profit (as he has already drawn part of his profits in advance). We strongly advise that this method (of increasing the active partner’s profit margin) be implemented and not the former method, where Zaid is give a salary.

سوال-کيا فرماتے ہيں علماۓدين ومفتيان شرع متين مسئلہ ذيل کے بارے ميں: کہ دوآدمی کسی کاروبار ميں شريک ہو اور دونوں کے سرمايہ کا تناسب بھی برابر ہو دونوں ميں  سے ايک  کام بھی جانتا ہو، تو کيا کام کرنے والے شريک کے ليےاپنے نفع کے علاوہ کام کی الگ اجرت لينا جائز ہے يا نہيں؟

خلاصہ يہ ہے کہ ايک شريک اپنے دوسرے شريک کو اجارہ پر لے سکتا ہے يا نہيں؟ احسن فتاوی 7/328 ميں کتاب الاجارہ ميں يہ مسئلہ حضرت مفتی صا حب  نے لکھا ہے کہ شريک اجارہ پر لينا جائز ہے، باقی حضرات مفتيان کرام نے اس کو منع لکھا ہے، ان دونوں باتوں ميں سے کون سی بات عوام کے سامنے لانی چاہیے؟

الجواب وباللہ التوفيق: اس مسئلہ ميں دومعاملے الگ الگ ہيں ايک معاملہ يہ ہے کہ دونوں کا برابر پيسے دے کر کے کاروبار ميں برابر کا شريک ہو جانا يہ معاملہ شرکت کا ہے دوسرا  معاملہ دونوں ميں سے ايک کو اجرت دے کر کے اجير بنانا، توشريعت ميں ايک معاملہ کو دوسرے معاملہ  ميں داخل کر کے ايک ساتھ معاملہ کرنے کو ناجائز قرار ديا گيا ہے، جن حضرات نےاس معاملہ کو نا جائز کہا ہے، وہ اسی وجہ سےہے کہ اس کے اندر صفقہ  درصفقہ لازم آتا ہے، جيسا کہ امداد الفتاوی 3/517 ميں ہے اور اگر اس طريقہ سے کيا جاۓ کہ اولا دونوں کاروبار ميں برابر پيسے دے کر کے شريک ہو جائیں اور دونوں نفع و نقصان ميں برابر  کے شريک ہو جائيں،اس کے بعددوسرا معاملہ الگ سے کيا جاوے کہ جو کام جانتا ہے، وہ ا لگ سے اجرت لے کر کام کرتا رہے گا، اسيی صورت ميں معاملے الگ الگ ہو جائيں گے، کام کرنے کی وجہ سےاس کو اجرت ملا کرےگی ارو اجرت کا تعلق نفع  و نقصان سے نہيں ہے اور اس طرح کے معاملہ کو حضرت تھا نوی نے امداد الفتاوی  ميں اسی وجہ سے  جائز قرار ديا ہے، مگر صاحب احسن الفتاوی نےاحسن الفتاوی 7/328 ميں تعامل ناس کی وجہ سے دونوں صورتوں کو جائز قرار ديا ہے-(فتاوی قاسميہ/ج20/ص57-58)

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعَتَيْنِ ‌فِي ‌صَفْقَةٍ ‌وَاحِدَةٍ. رَوَاهُ فِي شرح السّنة
