Answered as per Hanafi Fiqh by Askimam.org

Fatwa 15869 refers. using the same reasoning, how i it that the stoning of an adulterer is accepted based on Hadith and not Quran? Morover i was told that Hadrat Umar [ra] stated that he is concerned that “later generations of Muslims would say that the verse on stoning is not found in the Quran and hence abndon the practice.” With all due respect – did Allah not know that? i say that as a rethorical question in search of understanding. shukran

It has not been clarified as to what reasoning you are referring to in your query. Please clarify the reasoning in order to answer the question. However, hereunder is some information on the ruling of lapidation:

The ruling of rajm (lapidation) is not only proven through Ahadith, but Allah Ta’ala revealed an aayah (verse) of the Quran containing the ruling of rajm during the lifetime of Nabi (Sallallahu Alaihi Wasallam). The recitation of this verse was later abrogated during the lifetime of Nabi (Sallallahu Alaihi Wasallam) but the ruling still remains as a command of Allah Ta’ala.

The abovementioned narrations prove that the aayah of rajm was part of the Quran. The recitation of the aayah was later abrogated but the ruling remained.

Ubay bin Ka’ab (Radhiyallahu Anhu) said that Suarah Ahzab used to be equivalent to Surah Baqarah (in size). It also contained the aayah:

Ref – Mustadrak Al Hakim Vol.2 Pg.450 (Darul Kutub Al Ilmiyyah)

It is true that Umar (Radhiyallahu Anhu) had the concern that people would abandon the practice of lapidation and it is very much obvious that Allah Ta’ala, being All Knowing and All Wise, knew that people would leave out the practice; but Allah Ta’ala still abrogated the recitation of the aayah through His own wisdom and knowledge. It is not appropriate for a Muslim to question the knowledge and wisdom of Alaah Ta’ala. A Muslim is bound to follow the commandments of Allah Ta’ala, whether he understands the wisdom behind it or not.

However, some scholars have tried to explain the wisdom behind abrogating the recitation of the aayah and not abrogating the ruling. They explain that it is a test from Allah Ta’ala upon the Muslims that they follow the command of Allah Ta’ala in spite of the recitation being abrogated.

Moreover, we understand that you posed a rhetorical question in search of understanding, but it is advisable to avoid such words in future as they have a tone of disrespect in them.

And Allah knows best
