Studying Accounting and working as a Chartered Accountant

Assalam O Alaikum! 

Sir I’m a student of Chartered Accountancy (CA). Sir I’m confuse about the remuneration earned by Chartered Accountants. Sir We’re the person who hired for the Audit of a company. And we authorized the financial statements of the company.In Pakistan most of the companies taking loans and also major part of their operations are operate on leased basis assets. Sir when we authorized the whole transactions (involving those who bearing interest as well) is that true or ethical under the course of Islamic Sharia’h? Sir even the Financial statements for a country also audited by the Chartered Accountants what about it if a country operating on interest such as Pakistan? Is that fair to audit a banking company (as its all dealing is with interests and loans etc.)? Sir I’m too confused about my field I can’t rely on the statement that “agr mulk ka nizaam badalna hai to wo hum hi badal saktay mulk ko soood jaisi laanat sy nikaal saktay na k koi or” but sir how? It looks impossible for us…in this era especially at the present stage of Pakistan as well..

Sir kindly guide me about my field should I continue my studies or quit it? As it’s too hard to become a CA as well..yeh na ho hum itni mehnat k baad CA karein and at the end the whole CA looks Haram..

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

An accountant primarily records, audits, inspects, and prepares the financial statements and books of individuals or business clients. This is not considered to be an engagement in interest as he is merely recording that which has already occurred. However, an accountant may also have to deal directly with interest related transactions by initiating, valuing, proposing and giving advice in regards to interest yet to be discharged. This is impermissible.[1][2]

There are two important factors that must be considered in regards to any occupation:

1.        The permissibility of the occupation itself.

2.        The Source of remuneration (majority of the company’s/employers income).

If the company is a Muslim company which could be the case in Pakistan, and if the major source of a company/firm’s income is from Haram, then it will not be permissible for one to receive remuneration from such a company/firm. However, if the major source of the income is from Halal sources, then it will be permissible to receive remuneration from such a company/firm.[3]

وفي «عيون المسائل» : رجل أهدى إلى إنسان أو أضافه إن كان غالب ماله من حرام لا ينبغي أن يقبل ويأكل من طعامه ما لم يخبر أن ذلك المال حلال استقرضه أو ورثه، وإن كان غالب ماله من حلال فلا بأس بأن يقبل ما لم يتبين له أن ذلك من الحرام؛ وهذا لأن أموال الناس لا تخلو عن قليل حرام وتخلو عن كثيره، فيعتبر الغالب ويبنى الحكم عليه

ولا يجوز قبول هدية أمراء الجور؛ لأن الغالب في مالهم الحرمة إلا إذا علم أن أكثر ماله حلال بأن كان صاحب تجارة أو زرع فلا بأس به؛ لأن أموال الناس لا تخلو عن قليل حرام فالمعتبر الغالب، وكذا أكل طعامهم، كذا في الاختيار شرح المختار.

قال: (ولا يجوز قبول هدية أمراء الجور) لأن الغالب في مالهم الحرمة. قال: (إلا إذا علم أن أكثر ماله حلال) بأن كان صاحب تجارة أو زرع فلا بأس به، لأن أموال الناس لا تخلو عن قليل حرام والمعتبر الغالب،

 

مجمع الأنهر في شرح ملتقى الأبحر –  دار إحياء التراث العربي (529/2)

(وَلَا يَجُوزُ قَبُولُ هَدِيَّةِ أُمَرَاءَ الْجَوْرِ) لِأَنَّ الْغَالِبَ فِي مَالِهِمْ الْحُرْمَةُ (إلَّا إذَا عُلِمَ أَنَّ أَكْثَرَ مَالِهِ مِنْ حِلٍّ) بِأَنْ كَانَ صَاحِبَ تِجَارَةٍ أَوْ زَرْعٍ فَلَا بَأْسَ بِهِ.

وَفِي الْبَزَّازِيَّةِ غَالِبُ مَالِ الْمُهْدِي إنْ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَأَكْلِ مَالِهِ مَا لَمْ يَتَبَيَّنْ أَنَّهُ مِنْ حَرَامٍ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا يَخْلُو عَنْ حَرَامٍ فَيُعْتَبَرُ الْغَالِبُ وَإِنْ غَالَبَ مَالَهُ الْحَرَامُ لَا يَقْبَلُهَا

 

احسن الفتاوى (ج:7 ص:329)

اگر حلال وحرام آمدن کو خلط کر دیا جاتا ہے اور حلال کو الگ رکھنے پر ادارہ تیار نہ ہو تو اس کا حکم یہ ہے: “حلال وحرام مخلوط ہوں لیکن حلال غالب ہو تو اس سے اجرت لینا جائز ہے اور اگر حلال وحرام دونوں برابر ہوں یا حرام غالب ہوں تو جائز نہیں

 

فتاوى عثمانى (ج:3 ص:395)

جہاں تک حرام مال سے تنخاہ ملنے کا تعلق ہے، اس کے بارے مین شریعت کا اصول ہے کہ اگرایک مال حلال وحرام سے مخلوط ہو اور حرام مال زیادہ ہو تو اس سے تنخواہ یا ہدیہ لینا جائز نہیں، لیکن اگر حرام مال کم ہو تو جائز ہے
