Sharing out Business

A son has been in business with his father for quite some time. He is presently earning a monthly salary and has been in the business for over 15 years. What is the best way for the business to be organized before the death of the father as he is the only sibling who is working and has worked with the father? The potential heirs in case the father passes away are a wife, another son and three daughters. The other son has his own business.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

We advise the issue be discussed with the father first. If he has some concerns, then you may request him to make some proposals. While you have spent a considerable period of 15 years in the business, the father may also have other considerations. We can offer meaningful advises after considering the different angles of the issue.

 وَلَوْ وَهَبَ رَجُلٌ شَيْئًا لِأَوْلَادِهِ فِي الصِّحَّةِ وَأَرَادَ تَفْضِيلَ الْبَعْضِ عَلَى الْبَعْضِ فِي ذَلِكَ لَا رِوَايَةَ لِهَذَا فِي الْأَصْلِ عَنْ أَصْحَابِنَا، وَرُوِيَ عَنْ أَبِي حَنِيفَةَ – رَحِمَهُ اللَّهُ تَعَالَى – أَنَّهُ لَا بَأْسَ بِهِ إذَا كَانَ التَّفْضِيلُ لِزِيَادَةِ فَضْلٍ لَهُ فِي الدِّينِ، وَإِنْ كَانَا سَوَاءً يُكْرَهُ وَرَوَى الْمُعَلَّى عَنْ أَبِي يُوسُفَ – رَحِمَهُ اللَّهُ تَعَالَى – أَنَّهُ لَا بَأْسَ بِهِ إذَا لَمْ يَقْصِدْ بِهِ الْإِضْرَارَ، وَإِنْ قَصَدَ بِهِ الْإِضْرَارَ سَوَّى بَيْنَهُمْ يُعْطِي الِابْنَةَ مِثْلَ مَا يُعْطِي لِلِابْنِ وَعَلَيْهِ الْفَتْوَى هَكَذَا فِي فَتَاوَى قَاضِي خَانْ وَهُوَ الْمُخْتَارُ، كَذَا فِي الظَّهِيرِيَّةِ
