Regarding the Paternity of an Illegitimate Child

Answered as per Shafi'i Fiqh by Shafiifiqh.com

Question:

Assalamu aleikum respected ‘Ulama’,

Is a 6-year-old girl whose father being a converted muslim did not marry (neither nikah nor by a worldly procedure – they just lived together) her mother being a non-muslim (but later the mother converted and left the man taking the child with her) still her father and has thereof all the rights the Shari’ah grants to a father? I need your help because I heard such a man is a considered a total stranger to the child and a non-mahram and its haram to say to the girl he is her father and she has to observe hijab while with him. The child is approaching her lunar 7 years – the time I should start treating her like an adult – please help!

Answer:

الحمد لله رب العالمين ، وصلى الله على سيدنا محمد وعلى آله وصحبه أجمعين، وبالله التوفيق
