Question:
Can a Shafi’i get marry without a wali if making taqlid of Abu Hanifa?
Answer:

The Shafi’i School’s opinion is that a marriage without the bride’s wali is invalid. Thus, if following the Shafi’i School on the issue, it is not possible to marry without a wali. With that, it is valid for one to follow (i.e. taqlid), in whole or in part, any authority (i.e. mujtahid) that one wishes. This permission is not contingent on need or hardship.
Thus, the permission to follow an authority from outside the School would extend to a person who wishes to follow Imam Abu Hanifa, for example, on the issue of marriage without a wali.
The following is a fatwa from Sh. Ahdal’s ‘Umdat al-Mufti wa al-Mustafti v. 1, p. 93 which discusses the issue at hand. Those interested may consult it for further detail:
مسألة يجوز لشافعي نكاح امرأة بشاهدين بدون ولي تقليدا لأبي حنيفة في ذلك كما أفتى به أبو الفتح المزجد قال لتجويزهم تقليد من شاء من المجتهدين في جميع مذاهبهم أو بعضها ولا ينكر إلا المجمع على تحريمه أو ما اعتقد الفاعل حراما وبذلك أفتى العلامة عبد الرحمن البجلي تلميذ ابن زياد المقصري وقال السيد السمهودي المسائل الفرعية لا يعاقب عليها مع التقليد وقد قال عدم اشتراط الولي الكوفيون والشعبي والزهري قالوا عقدها على نفسها جائز وليس الولي من أركان العقد بل من تمامها ذكره الزرقاني في شرح الموطأ ويشترط لصحة التقليد أن يراعى جميع الشروط التي يعتبرها أبو حنيفة لصحة العقد واشترط الأشخر لصحة التقليد أن يكون لضرورة أي لمشقة لا تحتمل عادة قال أما مع عدمها فيحرم قال الشيخ محمد بن زياد الوضاحي الشرعبي لم أر من عد ذلك في شروط التقليد بل في فتاوى شيخ الإسلام عبد الرحمن بن عبد الكريم بن زياد المقصري ما يفيد أنه يجوز التقليد بلا حاجة قلت وكلام جميع الأصحاب فإنهم يطلقون جواز التقليد من غير تقييد والأخذ بإطلاقهم هو الصحيح اه كما في عمدة المفتي والمستفتي.
