It doesn`t Avail to Pay the Zakah of someone without their Permission

I want to pay the Zakah of my sister`s gold bracelets without asking her permission. What is the ruling of Sharia on this?

Answer:

Praise be to Allah, The Lord of the Worlds.

The majority of the Muslim scholars are agreed that Zakah isn`t due on jewelry used as ornaments of a woman. We have already explained this in Fatwa No. (525).

However, it doesn`t avail to pay the Zakah of someone else`s jewelry-in order to be on the safe side of Sharia-without asking their permission and intention to do so because Zakah is an act of worship; thus, intention is a must.

An-Nawawi(May Allah be pleased with him) said, "Our fellow scholars said, "The Muslim scholars are agreed that paying Zakatul Fitr on behalf of a non-dependent without their permission doesn`t avail because Zakah is an act of worship for which a responsible person remains liable if paid without their permission."{Al-Majmou`, 6/100}. And Allah The Almighty knows best.
