During Nikah if a man give right of divorce to his wife in presence of witness and then after sometime his wife keeping in mind the misbehavior of her husband, availing the right to divorce, divorce her husband in the court, will this kind of divorce be acceptable?
If a woman proposes something as a condition before marriage and her right and the husband gives it to her then she can use that right later. However, she chooses to exercise her right, she can do it through the court or some other means. If the woman herself didn’t demand it rather her husband gave it to her that’s also permissible.
