Suhoor and Niyat

Assalam Alaikum Mufti Sahab,

If a person has completed the Suhoor say around 4.30 am and has made intention to start the fast and then remembers or gets the urge to drink/eat something else (the Suhoor end time is 5.30 am), can that person eat/drink since there is still time left for the fast to start? Or once the intention has been established (in this case around 4.30 am) and then something is eaten it will be considered as breaking the fast even if there was time for the Sehri to end?

After making “niyyat” for the fast, if there is still time for sehri, it is alright to eat. It will not invalidate the fast.
