Assalamualaikum Mufti Hazrat!

Mera nikah hua hai. Ye mera bhi, aur meri ehliya ka bhi doosra nikah hai.Inke saath mera ek bada azwaaji masla  me hua tha jab meri biwi ne mere bade ladke  par haath uthane ki koshish kee thee, Jiski wajah se maine ye muamle ko Shariah Board me bhi pesh kiya tha.Khair ab masla ye hai ke meri biwi  mujh par ilzaam laga rahee hai ke maine use maara hai aur mujhe arrest karwake ek criminal case mujh par dayer kiya hai. Halanke maine community members ke saamne pesh kiya hai.  Quran ki aur apne bacchon ki qasam khayee ke ye ilzam ghalat hai. Iske bar’ask meri biwi ne dono  (Quran aur unka India me pehla bachcha)ki qasme khaane se inkaar kar diya.Maine phir usse kaha hai ke agar wo Court me aakar mere qilaaf jhooti gawahi degi, “to phir to wo apna aakhri din hunga”. Meri niyyat ye hai ke mai phir Qanooni taur par legal divorce ki kaarwahi shuroo karunga. Shara’ee koi niyyat nahi hai. (Ek bhi nahi) Maine uski wazaahat bhi kee ke jab tum chahre ke main jail me chale jaaon, to phir to apna ek ghar me rehna mushkil hai, kyonke aainda ke liye meri koi safety nahi hai.Lekin wo ab court me jaana chah rahee hai qilaf gawahi dene.To mera sawal ye hai ke inke Court me aa jane se kya shara’ee nikah baaqi rahega ya nahi?Allah aap hazrat ko be inteha jaza e khair ata farmaye!Assalamualaikum wa rahmatullah.

As per the situation described in your question, when you stated the words “to phir to wo apna aakhri din hunga” regarding your wife going to the court, and clarified that you did not have an intention to issue divorce to your wife by this statement, no divorce has taken effect. You are still considered husband and wife as per the teachings of Islamic Shari‘ah.
