Job in the administration of a federal state

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

As I went through the answeres, I found an answere relating to the job of the lawyer. I found it very interesting, because some people i know are saying that every contact to non – islamic law should be avoided. So jobs like lawyer, judge are absolutely forbidden for muslims. Therefore I were in doubt whether I should change my college or not – thank you for the answere on “sunnipath.com”!

But I have another question which is similar to the “lawyer-question”. In austria we can work after finishing study of law in the administration. That would include that e.g. you would have to allow or to dismisse an application because of guidelines of the legislator.

I would like to work in the section which has to do with foreigners (e.g. visa, employement permit …). Can I take the conditions which are realted to the job of a lawyer or are there specific conditions I have to consider?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

I pray this finds you in the best of health and spirits.

What you deduced that every contact to non-Islamic law should be avoided is an incorrect interpolation. What must be avoided is something that is explicitly and completely in contravention to the Shariah–which is not normally the case in legal contracts (as the general principles that law and contracts seek to uphold are essentially the same in Islamic and other legal systems–justice, fairness, fulfillment of rights, clarity, avoidance of dispute, etc.) [Zarqa, al-Madhkhal]

The job you mention would not appear problematic. However, it is best to discuss their details with a reliable local scholar of knowledge and understanding.

And Allah alone gives success.
