Signing a contract which contains a payment clause on interest

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

Is there anything haram about signing the below clause? The clause is from a standard construction document titled CCDC 2.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

Contemporary Hanafi scholars explain that one can enter this type of contract (similar to a credit card transaction) if:

a) one is determined to pay before the transaction incurs riba,

b) one has the means to make the payments on time,

c) and one is reasonably sure that they will actually do so.

And Allah alone gives success.

Wassalam,

Faraz Rabbani
