Is a Muslim burial required?

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

There was a sister who recently converted and then passed away shortly after her conversion. Almost all of her family is non-Muslim. I wanted  to know what the ruling regarding this situation is, as it might be difficult to get an appropriate burial.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

Washing a dead Muslim and burying them Islamically is a communal obligation (fard kifaya). [Ibn Abidin, Radd al-Muhtar]

Those aware of the issue, and the community at large need to take the reasonable means to ensure this duty is properly discharged. It is the right of the deceased, as a Muslim, to be washed and buried, and their family should respect this.

Consult with local scholars or community leaders regarding the most effective ways of going about this.

Jazak Allah khayr.

Wassalam.
