Q: For rotating money in the business, one person will be collecting a fixed amount from the 10 persons for the 11 months (including himself). Each month he will gather the entire amount and for the first month he will take the entire amount himself. For the remaining months, whoevers turn its is will take whole collected amount and the first person will take a small amount of commission (fixed amount) as the maintenance charge of this system. Is this system allowed in Islam? Is the commission amount interest?
A: If really some type of service (work) is required to manage this fund and in lieu of the service the money is taken, it will be permissible.
And Allah Ta’ala (الله تعالى) knows best.
الإجارة عقد على المنافع بعوض لأن الإجارة في اللغة بيع المنافع والقياس يأبى جوازه لأن المعقود عليه المنفعة وهي معدومة وإضافة التمليك إلى ما سيوجد لا يصح إلا أنا جوزناه لحاجة الناس إليه وقد شهدت بصحتها الآثار وهو قوله عليه الصلاة والسلام اعطوا الأجير أجره قبل أن يجف عرقه وقوله عليه الصلاة والسلام من استأجر أجيرا فليعلمه أجره وتنعقد ساعة فساعة على حسب حدوث المنفعة والدار أقيمت مقام المنفعة في حق إضافة العقد إليها ليرتبط الإيجاب بالقبول ثم عمله يظهر في حق المنفعة تملكا واستحقاقا حال وجود المنفعة ولا تصح حتى تكون المنافع معلومة (الهداية 3/293)
