Musaafirs Salaah in the haram of Mecca and Medina

Q: Could you elaborate on the rules pertaining to Salaah being performed in the haram of Mecca and Medina.

  1. A person staying in each place for a maximum of 7 days each and then returning to South Africa.
  2. A person staying in Medina for 10 days and then Mecca for 10 days

Bismillaah

A: 

  1. If you are performing the namaaz behind the imaam then you will read the namaaz as the imaam performs them. However if you are reading it individually or behind a person who is a musaafir like yourself then you will make qasr.
  2. As above. 

( وصح اقتداء المقيم بالمسافر في الوقت وبعده فإذا قام ) المقيم ( إلى الإتمام لا يقرأ ) ولا يسجد للسهو ( في الأصح ) (الدر المختار 1/129)

( ولا يزال ) المسافر الذي استحكم سفره بمضي ثلاثة أيام مسافرا ( يقصر حتى يدخل مصره ) يعني وطنه الأصلي ( أو ينوي إقامته نصف شهر ببلد أو قرية ) قدره ابن عباس وابن عمر رضي الله عنهم وإذا لم يستحكم سفره بأن أراد الرجوع لوطنه قبل مضي ثلاثة أيام يتم بمجرد الركوع وإن لم يصل لوطنه لنقضه السفر لأنه ترك بخلاف السفر لا يوجد بمجرد النية حتى يسير لأنه فعل (حاشية الطحطاوي 425)
