Q: If one is totally in debt. What is the stance with regard to Zakaat?
A: If after deducting his debts and liabilities, he does not possess the zakaat nisaab, zakaat will not be compulsory upon him.
And Allah Ta’ala knows best.
( وسببه ) أي سبب افتراضها ( ملك نصاب حولي ) نسبه للحول لحولانه عليه ( تام ) … ( فارغ عن دين له مطالب من جهة العباد ) ( الدر المختار 2/259)
