Eating the fruit of a tree growing in the masjid yard

Q: Is it permissible to eat the fruit of a tree growing in the masjid yard?

Bismillaah

A: If the fruit-bearing trees are for the income of the masjid it will be impermissible and if it is not for the income of the masjid it will be permissible provided one acquires permission from the trustees.

لو غرس شجرة للمسجد فثمرتها للمسجد (الشامية 1/661), غرس فى المسجد أشجاراً تثمر إن غرس للسبيل فلكل مسلم الأكل وإلّا فتباع لمصالح المسجد (الدر المختار مع الشامية 4/432)
