Q: Are ladies permitted to stand in the saffs of the men in jamaat salaah. In Bahisti Zewar under the section “Prerequisites of Salaah” there is a masalah that says that the Imaam must make niyyat for a woman who intends joining the Jamaat Salaah if she is standing in line with the men. However if she is standing behind them, then the Imaam does not have to make niyyat for her. This masalah seems to show permissibility for the women to be in line with the men?

Are Ladies Permitted to stand in the saffs of the men in Jamaat Salaah?

A: It is more rewarding for women to perform their salaah at home. However, if a woman performs her salaah with Jamaat in the masjid, she should stand behind the saffs of the men. She should not stand in the saff of the men. If she stands in the saff of the men, though her salaah will be valid since the Imaam made niyyat for the women, however the salaah of those men, besides whom she is standing, will break. The mas’alah in ‘Behishti Zewar’ is not encouraging women to stand next to the men rather it is only explaining the shari ruling in the case where a woman stood in the men’s saff.

It is a prerequisite for the validity of women’s salaah (behind the Imaam) that the Imaam makes niyyat of leading them in salaah. This law pertains to all salaah with the exception of Jumuah and Eid salaah. In the case of Jumuah and Eid salaah, even if the Imaam did not make the niyyat for leading the women, their salaah will be valid.

Note: There are two views recorded in the Hanafi mazhab regarding the Imaam making niyyat for leading women in salaah.

  1. The Imaam does not have to make niyyat for the women if they are standing behind the saff of men. If they stand in the saff of the men, their salaah will only be valid if the Imaam makes niyyat for them (as recorded in Hidaayah. This view is mentioned in Behishti Zewar).
  2. The Imaam has to make niyyat for the women in all cases whether they stand in the saff of the men or they stand behind the saff of the men (as recorded in Raddul Muhtaar).

From the above-mentioned two views, the second view is the preferred view in the Hanafi mazhab.

( وإن أم نساء فإن اقتدت به ) المرأة ( محاذية لرجل في غير صلاة جنازة فلا بد ) لصحة صلاتها ( من نية إماميتها ) لئلا يلزم الفساد بالمحاذاة بلا التزام ( وإن لم تقتد محاذية اختلف فيه ) فقيل يشترط وقيل لا كجنازة إجماعا وكجمعة وعيد على الأصح خلاصة وأشباه ( الدر المختار 1/425)

( وإلا ) ينوها ( فسدت صلاتها )

و قال في رد المحتار : وظاهر عود الضمير في صلاتها على المرأة المحاذية أي لإمام أو لمقتد أنها لو اقتدت غير محاذية لأحد صح اقتداؤها وإن لم ينوها إلا إذا نفى إمامة النساء كما في القهستاني وحينئذ فلا يشترط لصحة اقتداء المرأة نية الإمام إمامتها إلا إذا كانت محاذية وإلا فلا يشترط وقدم المصنف في بحث النية أن فيه اختلافا وقدمنا هناك عن الحلية أنه يشترط أن لا تتقدم بعد وتحاذي أحدا من إمام أو مأموم فإن تقدمت وحاذت لا يبقى اقتداؤها ولا تتم صلاتها ا هـ وذكر في النهاية هنا أن هذا قول أبي حنيفة الأول وظاهره أن قوله الأخير اشتراط النية مطلقا والعمل على المتأخر كما لا يخفى ولهذا أطلق في متن المختار قوله ولا تدخل المرأة في صلاة الرجال إلا أن ينويها الإمام ومثله في متن المجمع (رد المحتار 1/576)
