Aqeeqah for a child born out of wedlock

Q: Can a aqeeqah be done for a child born out of wedlock as the mother is Hindu and the father is Muslim. The father wants to name the child and give him his surname as well and has done all things necessary as to the rights of the child born. Can aqeeqah be done and can the child carry the fathers name?

Bismillaah

A: The child does not belong to him. There was no nikaah so the child belongs to the mother. They are living in a haraam zina relationship.

And Allah Ta’ala (الله تعالى) knows best.
