Q: If a patient doesn’t settle his debts with a doctor for treatment and medication he received, or a customer doesn’t settle his accounts with a shopkeeper for goods that were sold to him, and the doctor or the shopkeeper respectively file a case against them and the matter goes to court, can the doctor or shopkeeper hold the client responsible for the court charges and the lawyer’s fees?
A: It is not permissible for the doctor or shopkeeper to hold the client responsible for the lawyer’s fees and the court charges. However, if the client refused to appear in court, and there was some cost incurred in having him brought to the court, then since he was the cause for these costs being incurred through refusing to cooperate, he can be held responsible for these costs.

وأجرة المحضر على المدعي هو الأصح بحر عن البزازية وفي الخانية على المتمرد وهو الصحيح وكذا السلطان والمفتي والفقيه…
قال الشامي: (قوله: وأجرة المحضر إلخ) بضم أوله وكسر ثالثه هو من يحضر الخصم، وعبارة البحر هكذا وفي البزازية: ويستعين بأعوان الوالي على الإحضار، وأجرة الإشخاص في بيت المال وقيل على المتمرد في المصر من نصف درهم إلى درهم وفي خارجه لكل فرسخ ثلاثة دراهم أو أربعة، وأجرة الموكل على المدعي وهو الأصح وفي الذخيرة أنه المشخص وهو المأمور بملازمة المدعى عليه اهـ، والإشخاص بالكسر بمعنى الإحضار فقد فرق بين المحضر وبين الملازم، وهذا غير ما نقله الشارح فتأمل. وفي منية المفتي مؤنة المشخص قيل في بيت المال وفي الأصح على المتمرد اهـ، وهذا ما في الخانية. والحاصل: أن الصحيح أن أجرة المشخص بمعنى الملازم على المدعي وبمعنى الرسول المحضر على المدعى عليه لو تمرد بمعنى امتنع عن الحضور وإلا فعلى المدعي، هذا خلاصة ما في شرح الوهبانية.
