Questions on Hajj

QUESTION:

Please specify whether the actions taken are ok.

If not please mention what we should do. Dam or Sadaqah. I know that dam should be done in Haram area. What about Sadaqah. Should it also be given in Haram area.

1) Nowadays due to lot of people the Saudi govt is also putting some

tents outside the boundary of mina and these tents are located in Muzdalafah. Saudi Aalims has given fatwa that due to lack of space this space should be considered in Mina also and they called it mina extension.. Any how on first day (8 Thul Hijjah) we spend night in our tents i.e. in Muzdalafah. Is this action OK.

2) After spending the daytime in Arafat (9th Thul Hijjah) and while

returning back to our tents we stopped in Muzdalafah Ground until 1230 night because we were with our families and after 1230 night we started for our tents. On reaching the tents we took our beds outside of tents and sleep outside with our families on the ground as our tents were in Muzdalafah. We slept outside until some time before Fajr prayer due to cold weather. Is this OK.

3) Next day i.e. 10th Thul Hijjah I went for Rami (stoning). Due to

crowd I took also stones for my wife. After finishing my Rami I also throw stones for my wife. Is this action ok that my wife did not stone herself and he gave her stones to me.

4) After Tawaaf Ifaadhah we spend all nights in our tents (i.e. located in

Muzdalafah and said to be mina extension) and we did not went to mina except for Rami. Is this OK.


Answer:

1)      Yes this action was correct.

2)      It is Sunnah to spend the night of Arafat in Muzdalafah, therefore no Damm or Sadaqah is due on you for spending the night in new Mina. However, it is Waajib to spend a little time in Muzdalafah after Subhus Saadiq. (Ad-Durrul Mukhtaar, Vol. 2, Page 193)

3)      If your wife was not ill and she had the ability to perform the Rami herself, then the Rami which you carried out on her behalf will not suffice since she is allowed to perform the Rami during the evening or at night. As a result one Damm becomes incumbent upon her for omitting the Rami. (Ad-Durrul Mukhtaar, Vol. 2, Page 225, Mu’allimul Hujjaj, Page186)

4)      Yes, this was fine.

 

If Sadaqah becomes Waajib on the Hajji due to committing a Jinayah, then the Sadaqah can be discharged out of the Haram, however the Damm must be performed in the Haram even though the one upon whom Damm is Waajib is not present in the Haram.
