Penalty for Late-Coming

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Assalamualaikum

Q1-A Principal( Muhtamim) of a Madrasah made a rule for the Asaatidha that which ever Ustaadh comes 5 minutes late to teach then 10 pounds will be deducted from his wages as a punishment, is this permissible according to Shari’ah? Please reply as soon as possible with reference to answer Jazakumullah, Wassalaam.

Answer:

It is not permissible for a principal to deduct 10 pounds as a punishment for arriving late. However it will be permissible for the administration to deduct an appropriate amount from the salary of the Ustaadh for arriving late or being absent i.e. if the salary is paid according to hours then the salary should be deducted from that hour accordingly. A monetary fine cannot be made liable in this instance. (Ahsanul Fataawaa, Vol.7, Page284/296)
