Q1-It has been stated in Fatwa Mahmoodiyah Vol. 2 pg 143 that if a Waajib was missed in Salaat then it is not Waajib to repeat the Salaat after the Fardh Salaat time has expired could you please check your answer in which you stated that it is Waajib even after the Fardh Salaat time has expired, I heard that the mention of Ibne Abedeen saying that it is Waajib is his opinion, but the fatwa rajih qoul is that it is not Waajib after the Salaat time has expired so what is your view?
Answer:
It is mentioned in Ad-Durrul Mukhtaar’ of Allamah Haskafi (R.A.A.) that it is Mustahab to repeat a Salaah which was rendered Makrooh after the elapsing of it’s time. Allamah Shaami (In Raddul Muhtaar) states further while explaining the above statement that Allamah Haskafi has mentioned this following that which is mentioned in Al-Bahrur Raaiq but Allamah Khairud Deen Ar-Ramali (R.A.A.) states that the wordings of Al-Bahrur Raaiq are unreliable. Allamah Shaami, after analysing this matter, has mentioned with the aid of other references that it is Waajib to repeat a Salaah which was rendered Makrooh even after the elapsing of the time. We rely on that which Allamah Shaami (R.A.A.) has stated that is why we passed the Fatwaa accordingly. It is from the fundamentals of issuing Fataawaa that a Fatwaa must not be passed by merely viewing the wordings of Ad-Durrul Mukhtaar. We cannot mention the exact text of Allamah Shaami (R.A.A.) so kindly refer to Raddul Muhtaar, Quetta version, Vol. 1, Page 535, Baabu Qadhaail Fawaait and Al-Bahrur Raaiq, Quetta version, Vol. 2, Page 80.
