Fines for Breaking Madrassah Rules

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Q1-Recently a principal of a Maktab made a rule for the Asaatizah that who ever breaks the rules of the Maktab then there will be a two pound fine for the Ustaadh and if the Ustaadh misses a day without notifying the office one day before then two days wages will be deducted is this permissible?

Answer:

The Ustaadh who does not comply with the rules of the Madrassah or Maktab will be sinful for breaking the rules and opposing the conditions of his contract.  However, he cannot be made liable for a fine.  In the case where an Ustaadh misses a day without prior notification he will be deprived of his salary of that particular day if it is mentioned in the contract or by mutual understanding.  However, it will not be permissible to deduct two days of salary for missing only one day of work.  (Ahsanul Fataawaa, Vol. 7, Page 284 and 296)
