Will for son and daughter

If someone writes a will for example 5000 pounds should go to one son and 5000 pounds should go to one daughter after his demise, does the will still stand after death or will the money be distributed according to Islamic law?

Answer

The assets of the deceased will be distributed according to the Islamic laws of inheritance. It is not lawful to make a will for an inheritor and any such will is void.

قال رسول الله صلى الله عليه وسلم: إن الله قد أعطى كل ذي حق حقه فلا وصية لوارث، رواه أبوداود (٢٨٧٠) والترمذي (٢١٢٠) والنسائي (٣٦٤٢) وابن ماجه (٢٧١٣). وقال في الأصل (٥/٤٤٤، طبعة قطر): وإذا أوصى الرجل بعبده لبعض ورثته ولأجنبي فإنه لا يجوز حصة الورثة من ذلك، انتهى۔
