QUESTION:

As Salaamu Alaikum,

If a Muslim man has to divide his estate among his children e.g. 2 males and 2 females does everyone get an equal share.

ANSWER:

Wa Alaikum As Salaam,

If he is dividing his estate while alive and wishes to give his children gifts from his estate, then he should divide it in a manner that a male and female get an equal share. However, if his estate is being divided after his death, then the distribution of his estate would be subjected to the laws of inheritance as given in the Holy Quran. This means that a boy will get twice the share of a girl, and this division will be considered as inheritance and not gifts. (Kitabul Fatawa Vol.6 Pages 315,316 Zam Zam Karachi 2008).
