Is Nutmeg in Food, Ḥalāl or Ḥarām?

Question:

Is nutmeg in food, ḥalāl or ḥarām?

In the name of Allāh, the Most Gracious, the Most Merciful

Answer:

According to Ḥanafī fiqh, the nutmeg spice used in foods is permissible if used in a quantity that does not lead to intoxication and also if it is not used specifically to get intoxicated. – (Rad Al-Muḥtār, Vol 6, Page 455, Dār Al-Fikr)1

1 الظَّاهِرُ أَنَّ هَذَا خَاصٌّ بِالْأَشْرِبَةِ الْمَائِعَةِ دُونَ الْجَامِدِ كَالْبَنْجِ وَالْأَفْيُونِ فَلَا يَحْرُمُ قَلِيلُهَا بَلْ كَثِيرُهَا الْمُسْكِرُ وَبِهِ صَرَّحَ ابْنُ حَجَرٍ فِي التُّحْفَةِ وَغَيْرِهِ، وَهُوَ مَفْهُومٌ مِنْ كَلَامِ أَئِمَّتِنَا لِأَنَّهُمْ عَدُّوهَا مِنْ الْأَدْوِيَةِ الْمُبَاحَةِ وَإِنْ حَرُمَ السُّكْرُ مِنْهَا بِالِاتِّفَاقِ كَمَا نَذْكُرُهُ، وَلَمْ نَرَ أَحَدًا قَالَ بِنَجَاسَتِهَا وَلَا بِنَجَاسَةِ نَحْوِ الزَّعْفَرَانِ مَعَ أَنَّ كَثِيرَهُ مُسْكِرٌ وَلَمْ يُحَرِّمُوا أَكْلَ قَلِيلِهِ أَيْضًا وَيَدُلُّ عَلَيْهِ أَنَّهُ لَا يُحَدُّ بِالسُّكْرِ مِنْهَا كَمَا يَأْتِي بِخِلَافِ الْمَائِعَةِ فَإِنَّهُ يُحَدُّ – كتاب الدر المختار وحاشية ابن عابدين رد المحتار ج٦/ ص٤٥٥ دار الفكر
