Divorce in the Heart

Answered by: Maulana Muhammad Asadullah Anwar Adam

Question:

I have lots of waswasa regarding talaq. One day I was bathing. I was thinking that I have no idea about when a man give talaq to heart and I gave talaq in the heart. (Imagine only) I went to qazi Sahab and tell him I gave the talaq (perhaps talk to myself). I am not realizing what I am saying that. But I had thought if he ask me how to give talaq then I say in my heart.

Does it count talaq?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Divorce occurs when a person utters or writes words that clearly mean he is currently giving a divorce or utters words that imply divorce while intending those words to mean divorce.[1]

What occurs in a person mind or heart alone without expressing it does not lead to divorce so in your case divorce does not occur.
