Parents Commanding Him to Earn for His Siblings

Question

A person’s parents command him to earn for his sibling who is able to earn for themselves. Is it his obligation to carry out his parent’s command in this case? What should he do in such a case?

بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

If one’s siblings are able to earn for themselves, then a person is not required to earn and spend on them to meet their daily necessities.[1] However, given the importance of obeying parents, if this person is well to do, then it will be preferable (mustahab) for him to assign a certain amount which he will give to his siblings. However, if giving them will result in him encroaching upon the rights of those upon whom he must spend, such as his wife and children, then he should not spend on his siblings.[2]

[1] الْأَبُ إذَا كَانَ فَقِيرًا مُعْسِرًا، أَوْ لَهُ أَوْلَادٌ صِغَارٌ مَحَاوِيجُ، وَابْنٌ كَبِيرٌ مُوسِرٌ يُجْبَرُ الِابْنُ عَلَى نَفَقَةِ أَبِيهِ وَنَفَقَةِ أَوْلَادِهِ الصِّغَارِ كَذَا فِي مُحِيطِ السَّرَخْسِيِّ…وَالنَّفَقَةُ لِكُلِّ ذِي رَحِمٍ مَحْرَمٍ إذَا كَانَ صَغِيرًا فَقِيرًا، أَوْ كَانَتْ امْرَأَةً بَالِغَةً فَقِيرَةً، أَوْ كَانَ ذَكَرًا فَقِيرًا زَمِنًا، أَوْ أَعْمَى وَيَجِبُ ذَلِكَ عَلَى قَدْرِ الْمِيرَاثِ وَيُجْبَرُ كَذَا فِي الْهِدَايَةِ وَتُعْتَبَرُ أَهْلِيَّةُ الْإِرْثِ لَا حَقِيقَتُهُ كَذَا فِي النُّقَايَةِ. لَا يَقْضِي بِنَفَقَةِ أَحَدٍ مِنْ ذَوِي الْأَرْحَامِ إذَا كَانَ غَنِيًّا أَمَّا الْكِبَارُ الْأَصِحَّاءُ فَلَا يَقْضِي لَهُمْ بِنَفَقَتِهِمْ عَلَى غَيْرِهِمْ، وَإِنْ كَانُوا فُقَرَاءَ.(الفتاوى الهندية ج 1 ص 587. دار الكتب العلمية)

(وَ) تَجِبُ أَيْضًا (لِكُلِّ ذِي رَحِمٍ مَحْرَمٍ صَغِيرٍ أَوْ أُنْثَى) مُطْلَقًا (وَلَوْ) كَانَتْ الْأُنْثَى (بَالِغَةً) صَحِيحَةً (أَوْ) كَانَ الذَّكَرُ (بَالِغًا) لَكِنْ (عَاجِزًا) عَنْ الْكَسْبِ (بِنَحْوِ زَمَانَةٍ) كَعَمًى وَعَتَهٍ وَفَلْجٍ، زَادَ فِي الْمُلْتَقَى وَالْمُخْتَارِ: أَوْ لَا يَحْسُنُ الْكَسْبُ لِحِرْفَةٍ أَوْ لِكَوْنِهِ مِنْ ذَوِي الْبُيُوتَاتِ أَوْ طَالِبَ عِلْمٍ (فَقِيرًا) حَالٌ مِنْ الْمَجْمُوعِ بِحَيْثُ تَحِلُّ لَهُ الصَّدَقَةُ وَلَوْ لَهُ مَنْزِلٌ وَخَادِمٌ عَلَى الصَّوَابِ بَدَائِعُ (بِقَدْرِ الْإِرْثِ) – {وَعَلَى الْوَارِثِ مِثْلُ ذَلِكَ} [البقرة: 233]- (وَ) لِذَا (يُجِيرُ عَلَيْهِ) .
