Child from Previous Marriage

Question

I married a Muslim, he had a child before we got married to each other. The mother is still in the picture, but they are not together. What are my rights and what is the correct way my husband should deal with this? He is always contacting her, even when the child is with me, what do I do?

Answer:

We understand that you are currently in an awkward situation where your husband has a child from a previous marriage and the mother of the child is in frequent contact with your husband. This is a very common scenario, and it is natural for you to feel somewhat uncomfortable. However, it is imperative that all three of you follow the guidelines of Shariah to navigate the potential difficulties.

I’m sure you understand that as parents of the child, it is inevitable for there to be contact between your husband and the mother. This is will be in the best interest of the child. Nevertheless, as they are not married, there shouldn’t be unnecessary contact between the two.

Neither your rights nor the rights of your husband are affected by this. The only reason your husband and the mother are in contact is to preserve the rights of the child.
