Is it permissible to use a security guard as an Imam?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I work in a multi-national company where I have to live at site for 14 days and then I go on leave for other 14 days of the month. On the field they have provided us a proper mosque. They also allow us to go to mosque for prayers even during duty hour. As a policy of the company due to some issues, they do not hire a proper Imam for the mosque and they say that Imamat must be done any of the colleagues present in the mosque for prayer. However, they ensure the provision of proper Imam during the holy month of Ramadan.
Our field staff inducted a person in field security department as a security guard. Company pays him the salary of a security guard but at field that person does not perform the duty of guard. Field staff only use him as an Imam of the mosque. Company’s management is not aware of this
(A) Is that imam earning halal provision and doing right job?
(B) If it is not right then can we offer our prayers under his Imamat?

Answer

(Fatwa: 1282/D=285/File D=1433)

It is right for the said person to do imamah and it is also lawful for you people to offer salah behind him. The salah of all of you shall be valid. However if he has been appointed as a security guard and he receives its salary and he does not perform his duty so he shall be sinful for this act and his salary to this extent shall be doubtful. If the management of the company is informed about it and the permission is sought then his salary shall be halal without any doubt.
