What is my mother’s share of my grandmother’s house, and who are the other share holders?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
We have a house of our grandmother. She had 2 sons and 2 daughters. 2 sons and 1 daughter died when our grandmother was alive and only daughter who survived during the life time of my grandmother is my mother. During the death of my grandmother she was a widow (her husband died couple of years before). My grandmother had 6 brothers and 3 sisters but during her death her 3 brothers are 2 sisters were alive. I would like to seek your advice in distributing the house to the entitled share holders. Please advise what would be the share of mother in my grandmother’s house and who would be other share holders in my grandmother’s house?

Answer

(Fatwa: 630/611/N=1433)

At the time of your grandmother’s death, if her husband (your grandfather) was not alive then the house left by her shall be divided into 16 shares, after due rights proceeding inheritance. Out of which your mother shall get 8 shares (i.e. half of the house), 2-2 shares shall go to all three brothers of your deceased grandmother each and 1-1 share to each of her alive sisters. And the deceased brothers and sisters shall get no shares from it. The detail of the division is as follows:

Details:
Daughter: 1×8 = 8
Alive Brothers: 3×2 = 6
Alive Sisters: 2×1 = 2
Total: 16 shares
