Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalam o Alaikum wa rahmat ULLAH i wa Barakatuhu! Here is the problem that If the grand father of a person dies and his father is already dead. The grand son will recieve his part or not from grand father? If he recieves a part than what will be the ratio? If he has a property from his father , there is any part from his fathers property to other relatives like Uncle ( chacha ) etc or not? Please Give a comprehensive reply..

Answer

(Fatwa: 127/155=D/1429)

Father died before grandfather and grandfather died later while his other sons (uncle of the grandchildren) are alive, in this case the grandchildren will have no share in the property of grandfather. If grandfather died leaving no son, then write in detail whom he survived.

(2) In a man’s property his children, wife and parents have shares. If one leaves children behind then his brothers (uncle of his children) will not have any share. You should write down the detail, and then we can write the answer.
