Is the purity of the bride and groom essential for the validity of their nikah?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Whether the purity (paki) is essential for bride and bridegroom at the time of nikah?

Answer

(Fatwa: 1379/1101/B=1433)

The main thing in nikah is ijab-o-qubul (the exchange of proper words of nikah). If Muslim girl gave permission of nikah happily and then the Qazi performed the nikah and the boy accepted it then this nikah was valid as per the Shariah whether they are pure or impure; in each case nikah was valid and effective. However, nikah is an Islamic ritual along with being a contract, hence if nikah is done in the state of purity and wudhu it is far better and a source of virtue and blessing.
