Can a person distribute property according to his wish and will, or must it be shared after his death?

As salam alekum rehmatullahi wa barkatuhu. Janab Muftisahab, i want to know if a person has some property,can he distribute according to his wish and will, else after his life the property gets shared amongst his brothers,sisters,wife and children? Also is it correct if the person gives all his assets to his only child-a daughter,who is completely dependent on him,and avoid it from being shared among his brothers,sisters and wife as mentioned above? JazakAllahu khairunkasira

Answer

(Fatwa: 433/433/M=1431)

A man has full right to use his property during his lifetime. If he wishes he can sell it, gift or endow it. But if he wishes to distribute it among his children he should give equal shares to all his heirs i.e. whatever share he is giving to his son the same should be given to his daughter. We are asked in hadith to exercise equality among our children. It is not right to give the whole property to one daughter and deprive other children rather it is a sin and cruelty.
