How should the ancestral land & wealth of the expired son be distributed among the remaining siblings & heirs?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Our Grand father has left 30 acres of agricultural land inherited from his forefathers to 3 sons and 2 daughters, out of which 1 son has expired recently leaving behind his wife and 1 daughter. I would like to know the process of distribution of the ancestral land among the remaining brothers and sisters and the heirs of the expired son. Moreover, what is the process of distribution of the wealth and property earned by the expired son. I would appreciate references from the holy quran and ahadeeth.

Answer

(Fatwa: 2219/1817=B/1429)

The property of your grandfather and his late son shall be distributed in 64 shares, out of which each son will get 18 shares, each daughter 9 shares, the wife of the late son 2 shares while his daughter will get 8 shares.
