Do I need to pay zakah on my jewellery if my husband pays my zakah & has a house loan?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My husband is paying house loan so he does not have to pay zakah on his income. I have 20 grams gold. My husband pays my zakah on my jewellery every year. I am not earning. Now some people are saying that I do not have to pay zakah on my jewellery because most of my jewellery has been gifted to me by my husband and the jewellery belongs to both the husband and wife. As my husband is paying all my zakah so this year we are not entitled to pay zakah as my husband has house loan. Please advise me.

(Fatwa: 1327/904/L=10/1435)

If you own only 20 gram gold and you don’t have cash at all then zakah is not wajib on you. But if you have some extra money saved from your basic needs along the gold then zakah shall be wajib on you. Your husband is not liable to pay your zakah. You should pay your zakah yourself. However if your husband pays your zakah with your permission then it shall be valid. It should be noted that the ruling will apply in case he has given you the jewellery into your possession, not as loan only for use.
