Accepting Medical Treatment From A Non-Muslim Charitable Trust

Question:

Is it permissible to get the free medical treatment from the charitable trust of kafir?

Answer:

It will be permissible with the proviso that there is no ulterior motive behind such a charitable trust.

Sometimes such charitable trusts are established to lure people into accepting their false beliefs; consequently leading them out of the fold of Islam. Therefore, if there is a fear of being influenced by them in any way or there is a fear of them demanding some form of compensation in the future, their help should not be accepted. On the other hand, if one is sure that there are no motives of this sort, it will be permissible to accept.

واما هبة الكافرللمسلم فجائزة ايضا سواء كانت في دار الاسلام او في دار الكفر وحكم الصدقة كحكمالهبة فيما ذكرنا الا انه لا رجوع فيها على حال لانها خرجت على وجه القربةوالمثوبة وطلب رضوان الله (النتففي الفتاوى للسغدي ١/٥٢١)

اگر کوئی خارجیامر مانع ہو مثلا کسی فتنہ کا اندیشہ ہو یا وہ لوگ بعد میں ملکیت کا دعوی کرے یامسلمانوں پر احسان رکھیں یا دباؤ ڈالیں تو پھر براہ راست روپیہ وغیرہ ان سے نہ لیاجائے۔ (فتاوی محمودیہ، مکتبہ محمودیہ ج۲۲ ص۱۲۳)

حسبِ تحریرسوال جب ان چیزوں میں کوئی ناجائز چیز نہیں ہے اور کوئی مذہبی ناجائز دباؤ پڑنے کااحتمال بھی نہیں ہے تو ان چیزوں کو حاصل کر سکتے ہیں اور استعمال کر سکتے ہیں لیکنبارہا کا مشاہدہ اور تجربہ ہے کہ یہ اقوام انہی چیزوں کو اس طریق سے اپنی طرفجاذبیت پیدا کرکے پھر اپنے مذہبی تبلیغ و ترویح کا انہی چیزوں کو ذریعہ بتاتے ہیںاس لئے احتیاط لازم ہے۔ فقط واللہ تعالیٰ اعلم بالصواب۔ (منتخبات نظامالفتاوی  ج۱ ص۱۵۰)
