Marriage and Leaving Islam

Answered as per Hanafi Fiqh by CouncilofUlama.co.za

Q: My nephew married a Hindu woman (who accepted Islam). They had problems and separated. The women went back to her parents and went back to being a Hindu. Now she wants to come back to her husband who did not divorce her. What will be the Islamic ruling on this as she is no longer a Muslim?

A: The moment she renounced Islam her nikah (marriage) with your nephew terminated. It seems as though she is not serious about her Islam hence her accepting, rejecting and accepting. If she is genuinely serious about reconciling with your nephew she has to renew her Islam and a fresh nikah had to be made.
