Marriage over the Phone

Q: Is marriage (nikah) performed over the telephone valid?

A: To perform nikah by phone in such a way that the offer of the one spouse is directly posed to the other spouse and the other accepts at the same time telephonically will not be correct. However, if any one if the potential spouses, be it the bride or the groom, appoints a representative even though telephonically in the area of the other, then that representative can, on the instruction of teh absent spouse, get him or her married to the bride/groom.
