Do I have to receive my dowry and written talaqs to terminate the nikah?

I had my nikah in late November.Within three days of my nikah my ex-husband said to me verbally 12 times that he divorced me,meaning three times each when  he gave divorce.As he is in different country and I am in different so there was no physical contact after nikah and before divorce.He has still not given me written divorce as he is not nice person,he is happy to annoy me.My question is ,that is the divorce fully done and valid.Also , even without written divorce from him,can i marry someone else,once i finish three months to my divorce in early March.A muslim sister friend has found a suitable match for me who ants to marry me in end of March right after i complete three months to my divorce.But if my ex-husband does not give me divorce in writing then can i marry someone else based on valid verbal divorce only or i cant marry till written divorce from him.Also he is avoiding giving haq mehr.

So if he does not give me haqmehr and yet i complete three months to my divorce ,then am i stopped from marrying someone else.Overall want to know that oncei complete three months to my divorce, then if still  till then written divorce and haq mehr not given from him stop me from marrying someone else or no. Please guide me the best.I am a  in the now a truely distressed muslim female.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykumwa-rahmatullāhiwa-barakātuh.

The attitude of your ex-husband is unfortunate. We make dua Allah grant you peace and happiness Aameen.

 Your nikah with your husband terminated upon the first talaq he issued you as you and your husband did not meet each other and your’ll did not consummate the marriage.(1)(2)

Furthermore, in such circumstances there is no need for iddat. Accordingly you’re free to remarry.

If your ex-husband refuses to give mahr, that is a big sin, however it doesn’t stop you from remarrying.

 (وَإِنْ فَرَّقَ بَانَتْ) بِوَاحِدَةٍ) أَيْ إنْ فَرَّقَ الطَّلَاقَ بَانَتْ بِطَلْقَةٍ وَاحِدَةٍ وَذَلِكَ مِثْلُ أَنْ يَقُولَ أَنْتِ طَالِقٌ وَاحِدَةً وَوَاحِدَةً(١)

      وَوَاحِدَةً، أَوْ يَقُولَ أَنْتِ طَالِقٌ طَالِقٌ طَالِقٌ أَوْ يَقُولَ أَنْتِ طَالِقٌ أَنْتِ طَالِقٌ أَنْتِ طَالِقٌ(تبيين الحقائق ج٢ ٢١٣) 

                   (٢ )قال في التنوير قال لزوجته غير مدخول بها انت طالق ثلاثا وقعن وان فرق بانت بالاولي ولم تقع الثانية،و في الشرح (بانت بالاولي) لا الي عدة فلذا (لاتقع الثانية) بخلاف الموطوءة حيث يقع الكل(رد المحتار ج ٢) (نقل من احسن الفتاوى ٥/١٢٩)
