Tubal ligation

Answered as per Hanafi Fiqh by Askimam.org

From your website I understand that reversible methods of contraception are allowed under some conditions. Irreversible methods of contraception are prohibited and haraam.

Tubal ligation in females has been traditionally considered an irreversible method and thus haraam. However over the years newer techniques of Tubal ligation have been evolved as also newer methods of reversing the procedure thereby enabling conception to take place. Many centres show a success rate approaching 85% for conception following reversal of the ligation procedure. In light of the above would tubal ligation still be conisdered haram ?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Reversible tubal ligation is permissible due to medical and related needs[1][2]. You may refer to the following link for conditions of contraception.

The hurmat of tubal ligation is based on kufraan-i-ni’mah. The fact that the procedure stops a woman from giving birth temporarily or permanently is the reason why a woman cannot proceed with this procedure without necessitation. The hadith of خصى defends this opinion.

However, this is not applied upon a woman who is advised to take tubal ligation due to necessitation and Darurah.
